Im Rahmen der Untersuchung wird dem Schutzbereich des Art. 103 Abs. 3 GG als Ausdruck der Rechtssicherheit die strafprozessuale Wiederaufnahme zuungunsten des Freigesprochenen entgegengestellt. Im Rahmen dieser Untersuchung wird darauf eingegangen, ob die Wiederaufnahme des Strafverfahrens nach 362 StPO den in der Arbeit entwickelten Anforderungen an eine verfassungsrechtliche Rechtfertigung von Eingriffen in das Mehrfachverfolgungsverbot standhalten kann. »The Relationship between Legal Certainty and Substantive Justice in Article 103 (3) with Reference to the Reopening of Criminal Proceedings under 362 StPO. An Analysis of the Prohibition on Multiple Prosecutions, with Particular Reference to the Decision of the Federal Constitutional Court of 31 October 2023«: The thesis contrasts the reopening of criminal proceedings to the detriment of an acquitted person with the scope of protection afforded by Article 103 (3) GG as an expression of legal certainty. This study examines whether the reopening of criminal proceedings under 362 of the Code of Criminal Procedure (StPO) can satisfy the requirements set out in this thesis for a constitutional justification of interference with the prohibition on multiple prosecutions. Roman Gillner studied law at the University of Kiel from Oktober 2017 to November 2022, specializing in competition and copyright law. From March 2023 to April 2026, he worked as a research assistant at the chair of Criminal law, Criminal Procedure Law and Commercial Criminal Law at the university of Kiel. He also completed his doctorate there under the supervision of Prof. Dr. Andreas Hoyer in May 2026.
