Ausgehend von der umstrittenen Afghanistan-Entscheidung des IStGH aus 2019 untersucht die Arbeit, wann eine Strafverfolgung gem. Art. 53 Rom Statut nicht im "Interesse der Gerechtigkeit" liegt. Analysiert werden Rechtsprechung, die Praxis des Anklägers sowie wissenschaftliche Ansätze. Mithilfe klassischer Auslegungsmethoden entwickelt die Autorin eine eigene Konkretisierung des Begriffs und beleuchtet zudem das Ermessen des Anklägers sowie die gerichtliche Kontrolle einer solchen Entscheidung. »The interests of justice - Analysing the concept 'interests of justice' in Article 53 of the Rome Statute of the International Criminal Court«: In light of the ICC's controversial Afghanistan-decision in 2019, this thesis examines when prosecution under Art. 53 Rome Statute is not in the »interests of justice«. The author analyses relevant case law, the Prosecutor's practice, and scholarly approaches. Using classical methods of interpretation, she develops her own definition of the term. Finally, the author deals with the Prosecutor's discretion regarding the interests of justice and the judicial review of such a decision. Sophia Lieder studied law at the University of Bonn from 2014 to 2020. During this time, she worked as a student assistant at the Chair of Prof. Dr. Dr. Di Fabio. She passed her first state examination in 2020 at the Higher Regional Court of Cologne and began her doctoral research that same year. While receiving doctoral funding from the Studienstiftung des deutschen Volkes, Sophia Lieder worked as a research assistant at the Chair of Prof. Dr. Stuckenberg. In 2025 she received her doctoral degree and passed her second state examination in the Karlsruhe Higher Regional Court district. Sophia Lieder has been working as a public prosecutor since May 2026.
