Die Arbeit untersucht das Verhältnis von Verbraucherschiedsgerichtsbarkeit zu Mitteln des kollektiven Rechtsschutzes im U.S.-Recht (zur 'Class Action') und im deutschen Recht (insbesondere zur Abhilfeklage nach dem Verbraucherrechtedurchsetzungsgesetz). Ferner wird der Rechtsrahmen der Verbraucherschiedsgerichtsbarkeit im deutschen sowie im EU-Recht untersucht und werden Ansätze entwickelt, wie das von beiden Rechtsordnungen anerkannte System weiterentwickelt werden könnte. »Consumer Arbitration and Collective Redress. On the Relationship between Consumer Arbitration and Collective Redress in German and U.S. Law«: The thesis examines the relationship between consumer arbitration and collective redress mechanisms in U.S. (class actions) and German law (in particular, the newly enacted action for relief under the German Consumer Rights Enforcement Act (Verbraucherrechtedurchsetzungsgesetz)). It also examines the legal framework for consumer arbitration in German and EU law and develops approaches for how the system recognized by both legal systems can be developed further. Maximilian Nicolas Schulze studied law at the University of Bonn and the University of Oxford. After his First State Examination in 2018, he conducted an LL.M. at the University of California, Berkeley, as well as, from 2020 to 2022, did his practical legal training at the Regional Court of Cologne, Germany, with stages at the European Central Bank and a law firm in Washington, D.C. In 2025, he completed his doctoral studies with Professor Dr. Matthias Lehmann. Since 2024, Mr. Schulze is a lawyer in Munich, Germany.
