Eine der meistdiskutierten Fragestellungen im Zusammenhang mit 22 AGG ist, welche Tatsachen eine Benachteiligung wegen eines in 1 AGG genannten Grundes vermuten lassen, wann also ein hinreichendes Indiz i.S.d. 22 AGG vorliegt. Dieser Frage widmet sich die Arbeit. Dabei erfolgt zunächst eine eingehende Untersuchung möglicher Fallkonstellationen für taugliche Indizien. Im Anschluss werden die Indizienkonstellationen ausgewertet und systematisiert. »Indicative Facts within the Meaning of Section 22 AGG. Analysis of Suitable Indicia under the Burden-of-Proof Rule of Section 22 AGG«: One of the most widely debated issues in connection with Section 22 AGG concerns the question of under which circumstances sufficient indicative facts within the meaning of Section 22 AGG exist. The dissertation focuses on this question. To this end, the study first undertakes an in-depth examination of possible factual scenarios that may constitute suitable indicia. Subsequently, these constellations of indicative facts are evaluated and systematically categorized. Annabel Dornauer studied law at the University of Passau. Thereafter, she earned her doctorate at the Chair of Civil Law and Labor Law at the University of Passau, where she also worked as a research assistant during her doctoral studies. Since August 2025, she has been pursuing an LL.M. degree at Georgetown University in Washington, DC.
