Es wird die strafrechtliche Verantwortlichkeit bei einer Infektion mit SARS-CoV-2 nach den 223 ff. StGB untersucht. Insbesondere die Möglichkeit eines symptomlosen Verlaufs und der Nachweis der Kausalität erschweren eine solche Strafbarkeit. Nur die versuchte einfache Körperverletzung stellt ein denkbares Szenario dar. Die »Lücke« im deutschen Strafrecht kann aufgrund des Ultima-Ratio-Prinzips auch nicht durch ein neues abstraktes Gefährdungsdelikt geschlossen werden. »Bodily Harm in Light of the COVID-19 Pandemic.
