The Council Regulation (EC) No 207/2009 on the Community trade mark (CTMR) gives the proprietor a uniform right to undistorted use of a trade mark throughout the European Union. The trade mark will be obtained in a single procedure from the Office for Harmonization in the Internal Market (OHIM) in Alicante; and by that the application procedure will be made simpler and less expensive. It is fair to say: the CTM has proven to be a success story.
This commentary gives a detailed article-by-article analysis of the provision of the Regulation and its enforcement in each Member State of the European Union. Wherever feasible, the commentary provides an account of specific bibliography, gives a historical overview, shows the main features and principles underlying the provision, and analyses each paragraph with due regard to the case law of the European courts and the supreme courts of the Member States.
