Die vorliegende Arbeit untersucht die Zulässigkeit der Testamentsvollstreckung am einzelkaufmännischen Unternehmen vor dem Hintergrund der Dynamik, welche die Einführung der UG (haftungsbeschränkt) in der Diskussion um die Zulässigkeit hervorgerufen hat. Unternehmensrechtlich im Vordringen schwebt über der Testamentsvollstreckung am einzelkaufmännischen Unternehmen weiterhin das Verdikt der Erbrechtswidrigkeit. In diesem Spannungsverhältnis bewegt sich die vorliegende Arbeit. »Testamentary Execution over a Sole Proprietorship. Between a Paradigm Shift in Company Law and Violation of Inheritance Law«: The thesis examines the admissibility of testamentary execution over a sole proprietorship against the backdrop of the dynamics that the introduction of the UG (haftungsbeschränkt) has generated in the debate on this question. While, from the company-law perspective, its admissibility is increasingly being affirmed, the verdict of a violation of inheritance law con-tinues to loom over testamentary execution in this context. It is within this field of tension that the present study is situated. Daniel Feldmann studied law at the University of Muenster, including a period of study abroad in Lisbon, and passed the First State Examination in Law in 2020. He then began his doctoral research, while working as a research assistant at the chair of Prof. Dr. Frauke Wedemann in Muenster (Chair of Civil Law, German, European and International Commer-cial and Company Law). Since 2025, he has been a legal trainee (Rechtsreferendar) at the Regional Court of Duesseldorf.
