Der Autor untersucht ein klassisches Rechtsproblem aus zivilrechtlicher Perspektive: die Abgrenzung von Vorsatz und Fahrlässigkeit. Im Zentrum der Arbeit steht ein analytisch-mathematisches Modell zur Fassung des für die Vorsatzdogmatik des Bundesgerichtshofs maßgeblichen Kriteriums des »Billigens im Rechtssinne«. Das Modell greift die innere Einstellung über das ökonomische Konzept der Zahlungsbereitschaft auf. Subjektive Vor- und Nachteilspositionen werden monetarisiert, um ihre Realisierungswahrscheinlichkeiten gewichtet und in einem »Billigungsquotienten« zueinander ins Verhältnis gesetzt. Als Quintessenz leitet der Autor daraus eine gedankliche Anleitung zur Feststellung des »Billigens im Rechtssinne« ab. »Employing Willingness to Pay to Determine the Volitional Element of Intent in Private Law and a Conceptual Guide for Establishing 'Approval in the Legal Sense'«: The author examines a classic legal problem from a private law perspective: the distinction between intent and negligence. The centrepiece of the dissertation is an analytical mathematical model for capturing the criterion of 'approval in the legal sense', which is the key criterion of the Federal Court of Justice's doctrine of intent. The model grasps the inner mindset by applying the economic concept of willingness to pay. Subjectively advantageous and disadvantageous positions are monetised, weighted by their probabilities of realisation, and subsequently set in relation to one another to form a 'ratio of approval'. As the quintessence, the author derives therefrom a conceptual guide for determining 'approval in the legal sense'. Timothy Fuchs studied law and business administration at the Universität Mannheim and at the Humboldt-Universität zu Berlin. He subsequently was a research fellow at the Chair for Civil Law, Commercial and Corporate Law, Capital Markets Law, and Foundations of the Law held by Professor Dr. Andreas Engert at the Faculty of Law of the Freie Universität Berlin, where he also obtained his doctorate. Timothy Fuchs completed his legal clerkship (Rechtsreferendariat) at the Higher Regional Court of Berlin (Kammergericht), with placements including the Federal Chancellery (Bundeskanzleramt) and an international law firm in Berlin and London. He practices as an attorney (Rechtsanwalt) in Berlin as of 2024.
