Die Zuteilung von Mobilfunkfrequenzen durch die BNetzA tangiert Fragen von Wettbewerbsschutz und Netzausbau. Die jüngste Entscheidung der BNetzA, Frequenzrechte zu verlängern, hat der Autor zum Anlass genommen, die Ermessensparameter in diesem unionsrechtlich geprägten Rechtsrahmen zu untersuchen. Es zeigt sich, dass die vom BVerwG im Jahre 2011 angenommene »Vorprägung« der Ermessensentscheidung zugunsten einer Neuvergabe trotz Novellierung des TKG Bestand haben muss. »The Extension of Frequency Rights. An Analysis of the Amended Telecommunications Act in Light of the EU Electronic Communications Code«: The allocation of mobile radio frequencies by the Federal Network Agency (BNetzA) touches on issues of competition protection and network expansion. The author uses the recent decision to extend frequency rights as an opportunity to examine the discretionary parameters within this EU-law-influenced legal framework. It becomes apparent that the »predetermination« of the discretionary decision in favor of a reallocation, as assumed by the Federal Administrative Court (BVerwG) in 2011, must continue to apply despite amendments to the Telecommunications Act (TKG). Nicolas Hauschild studied law at the University of Münster from 2017 to 2022. He was awarded the Freundeskreis Rechtswissenschaft e.V. prize for outstanding performance in his First State Examination. He then completed a Master of Laws at the Harvard Law School in Cambridge, Massachusetts. From mid-2023, he pursued a doctorate under Professor Dr. Matthias Knauff, LL.M. Eur. at the Friedrich-Schiller-University of Jena. Alongside his doctoral studies, he worked as a research assistant in the Public Commercial Law department of a business law firm. In September 2025, he began his legal clerkship at the Higher Regional Court of Düsseldorf.
