Straftaten sollen sich nicht lohnen. Zu diesem Zweck wurde - neben dem in den vergangenen Jahren stark ausgeweiteten Einziehungsrecht - 1986 57 Abs. 6 StGB eingeführt. Die Vorschrift ermöglicht es, Häftlingen die Strafrestaussetzung allein deshalb zu versagen, weil sie den Verbleib ihrer Tatvorteile verschweigen und so deren Einziehung vereiteln. Bei Vorliegen der Voraussetzungen des 57 Abs. 1 StGB hält der Autor dies für verfehlt und plädiert daher für die Aufhebung des 57 Abs. 6 StGB. »Parole and Section 57 (6) of the German Criminal Code. Is the Convicted Person's Refusal to Surrender the Proceeds of the Crime a Convincing Reason for Refusing Parole?«: Crime should not pay. This imperative motivated the introduction of Section 57(6) of the German Criminal Code. This provision allows denying prisoners the suspension of their sentences solely because they conceal the whereabouts of the proceeds of their crimes, thereby preventing their confiscation. In cases where the assessment of social readjustment is favourable, the author considers this misguided and therefore advocates the repeal of Section 57 (6) of the German Criminal Code. Ninos Yoseph studied law at Johannes Gutenberg University Mainz and passed his first state law examination in 2018. From 2019 to 2021, he completed his legal clerkship with placements at the Regional Court and the Public Prosecutor's Office in Wiesbaden, among others.
