Whistleblower bewegen sich im Spannungsfeld zwischen dem strafrechtlichen Schutz von Geschäftsgeheimnissen und dem Risiko der eigenen Strafbarkeit. Umfassende europäische und nationale Neuregelungen haben dieses Spannungsfeld neu geformt. Die Arbeit untersucht die Strafbarkeit des Whistleblowers gem. 23 GeschGehG, beleuchtet die Schutzregeln des 3 Abs. 2 Var. 1 GeschGehG i. V. m. 6 Abs. 1, 33 Abs. 1 Nr. 2 und 3 HinSchG und des 5 Nr. 2 GeschGehG und bewertet den Hinweisgeberschutz im Vergleich zur alten Rechtslage. »Whistleblowing at the Intersection of Whistleblower Protection and Trade Secret Protection«: Whistleblowers face tension between criminal protection of trade secrets and protecting themselves against criminal liability. European and national reforms have reshaped this tension. This thesis examines whistleblowers' liability under Sec. 23 of the German Trade Secrets Act (GeschGehG), analyses other relevant protections under the German Trade Secrets Act and the Whistleblower Protection Act (HinSchG), and evaluates whistleblower protection in comparison to the previous legal situation. Carolin Baumeister studied law at University of Münster and Università degli Studi di Ferrara. Afterwards, she completed her legal clerkship in the district of the Düsseldorf Higher Regional Court. She has been working at a law firm specializing in white-collar crime since 2020. She began as a research assistant and has been practicing as an attorney since 2022. At the same time, she completed her thesis whilst working.
