Die große Reform der Vermögensabschöpfung von 2017 hat als Teil des neuen Opferentschädigungsverfahrens einen Insolvenzantrag der Staatsanwaltschaft in 111i Abs. 2 StPO eingeführt. Der Autor beleuchtet die Norm aus allen Blickwinkeln. Ausgehend von einem grundlegenden Versäumnis des Gesetzgebers macht er konkrete Reformvorschläge auf (unter-)gesetzlicher Ebene für eine verfassungskonforme und praxisgerechte Normauslegung. »The Insolvency Petition Filed by the Public Prosecutor's Office«: The reform of confiscation law in 2017 introduced an insolvency petition to be filed by the public prosecutor's office in Section 111i (2) of the Code of Criminal Procedure as part of the new victims' compensation procedure. The author examines this special insolvency petition from all angles and makes specific proposals for reform at the legislative and sub-legislative level to ensure that the provision is interpreted in a manner that is both constitutional and practical. Soeren Schneider studied law in Heidelberg, Mainz, and Valencia until February 2017, supported by a scholarship from the »Studienstiftung des deutschen Volkes«. This was followed by a legal traineeship in Hamburg, Madrid and San Francisco. After completing his second state examination in January 2020, he obtained his doctorate from Johannes Gutenberg University in Mainz. At the same time, he worked as a research assistant at an international law firm and in the German Bundestag, and in 2022/2023 he completed a master's degree in European Political and Governance Studies at the College of Europe (Bruges). Since the beginning of 2025, he has been working for the EU Commission in Luxembourg.
