Die Arbeit untersucht das Phänomen Upskirting. Zunächst werden die straf- und ordnungswidrigkeitsrechtlichen Sanktionsmöglichkeiten vor Inkrafttreten des 184k StGB im Jahr 2021 analysiert. Schwerpunktmäßig werden völker- und verfassungsrechtliche Implikationen, insbesondere eine mögliche Pönalisierungspflicht bzw. die strafverfassungsrechtliche Legitimität einer Pönalisierung erörtert. Ferner wird vertieft auf die Ausgestaltung und Anwendung von 184k StGB unter Einbezug kriminalpolitischer Aspekte eingegangen. »The Liability of Upskirting. A Phenomenological and Criminal Law Analysis of so-called Upskirting on the Occasion of the Introduction of Section 184k of the German Criminal Code (StGB) by the 59th Amendment to the Criminal Code (59. StRÄndG)«: This thesis examines the phenomenon of upskirting, analysing in particular the possible sanctions under criminal and administrative law before Section 184k of the German Criminal Code (StGB) comes into force in 2021. The focus is on implications under international and constitutional law, in particular a possible obligation to impose and the legitimacy of imposing penalties under criminal law. Furthermore, it takes an in-depth look at questions concerning the application of Section 184k StGB. Ron-Jo Koenen studied law in Trier. After passing the first First State Exam with a focus on criminal law in December 2019, he completed his doctorate at the University of Trier by 2025. While pursuing his doctorate, he worked as a research assistant at the Chair of German and European Criminal Law, Criminal Procedure Law and Commercial Criminal Law held by Prof. Dr. Mohamad El-Ghazi and at the Chair of Criminal Law and Criminal Procedure Law, including European and International Relations, held by Prof. Dr. Carina Dorneck, M. mel. Since November 2024, he has been completing his legal clerkship in the district of the Higher Regional Court of Koblenz.
