Mit Befassung des zuständigen Richters und der damit eröffneten Möglichkeit präventiven Grundrechtsschutzes endet die Eilkompetenz der Strafverfolgungsbehörden. Eine - unberechtigt - nicht rechtzeitige Entscheidung des Richters kann zum Beweis¬mittelverlust führen. Neben Ansätzen zur Verbesserung der Kommunikation und Nutzung des Fortschritts durch Digitalisierung könnte die Einführung eines - die richterliche Unabhängigkeit achtenden - strafprozessualen Sonderrechtsbehelfs Abhilfe schaffen. »The Urgent Powers of Law Enforcement Authorities in Cases of Imminent Danger. Consequences of the Federal Constitutional Court's Decision of 16 June 2015«: Once the case has been referred to the competent judge and the possibility of preventive protection of fundamental rights has been opened up, the urgent powers of the law enforcement authorities come to an end. An unjustified delay in the judge's decision may result in the loss of evidence. In addition to approaches aimed at improving communication and using the advances made possible by digitalization, the introduction of a special legal remedy in criminal proceedings that respects judicial independence could also help to resolve this issue. After studying law at the University of Münster, Paulina Noppeney completed her legal clerkship at the Regional Court of Münster. She worked as a research assistant at a commercial law firm in Düsseldorf in the field of corporate and tax law while working on her doctorate. Since 2025, she has been working as a lawyer at Luther in Berlin. There, she advises on all matters of individual and collective employment law as well as on compliance-related issues.
