Description
Die Arbeit untersucht die strafrechtliche Verantwortlichkeit von Leitungspersonen deutscher Muttergesellschaften für im Ausland eintretende, mit grenzüberschreitender wirtschaftlicher Betätigung verbundene Rechtsgutsverletzungen nach den Grundsätzen der strafrechtlichen Geschäftsherrenhaftung. Behandelt werden insbesondere Konzern- und Zulieferkonstellationen sowie die Bestimmung des maßgeblichen Sorgfaltsmaßstabs unter Berücksichtigung einschlägiger Sondernormen. »The Criminal Liability of Corporate Principals for Human Rights Abuses in Transnational Business Activities«: The dissertation draws on the German legal doctrine of Geschäftsherrenhaftung to examine the criminal liability of executives of German parent companies for harm to legally protected interests abroad arising from cross-border business activities. Special emphasis is placed on corporate group and supplier constellations as well as on determining the applicable standard of care in accordance with relevant statutory duties and regulatory provisions. Ann-Christin Hagedorn studied law at the University of Hanover. Following her completion of the first state examination in 2020, she served as a research associate at the Chair of Criminal Law and Criminal Procedure with Interdisciplinary Perspectives under Prof. Dr. Sascha Ziemann until February 2024, during which she wrote her doctoral dissertation. Since March 2024, she has been undertaking her legal clerkship within the jurisdiction of the Higher Regional Court of Celle.
