Die Verordnung (EU) 2019/452 schafft den ersten europäischen Rahmen zur Kontrolle ausländischer Direktinvestitionen. Die Untersuchung analysiert die unionsrechtlichen Kompetenzgrundlagen der sogenannten Screening-Verordnung und kommt zu dem Ergebnis, dass statt Art. 207 Abs. 2 AEUV vielmehr Art. 64 Abs. 3 AEUV als Rechtsgrundlage heranzuziehen ist. Rechtspolitisch wird die verstärkte Zusammenarbeit für ein Investitionskontrollregime vorgeschlagen. »Foreign Investment Screening in the European Union. Conflicts of Competence between the Member States and the Union«: Regulation (EU) 2019/452 establishes the first European framework for the screening of foreign direct investments. The thesis analyses the legal basis of the so-called »Screening Regulation« under Union law and concludes that the correct legal basis is Article 64(3) TFEU, rather than Article 207(2) TFEU. Alparslan Aksoylu studied law at the University of Osnabrück with additional training in economics, specialising in German and European Corporate and Capital Markets Law. He subsequently obtained an LL.M. in International Financial Law from King's College London and completed his doctoral studies under the supervision of Professor Dr. Fabian Wittreck at the University of Münster. During his legal traineeship at the Higher Regional Court of Düsseldorf and while pursuing his doctoral research, he worked at an international law firm in Düsseldorf, where he continues to practise as an attorney specialising in Corporate/M&A following completion of his legal qualification.
