5 GeschGehG sieht insgesamt vier Ausnahmen von den Verboten des 4 vor. Die Ausnahmen weisen Konkretisierungsbedarf auf. Diese Konkretisierung setzt sich die vorliegende Untersuchung zum Ziel. Dies gilt insbesondere für die Teilschranke zur Ausübung der freien Meinungsäußerung aus 5 Nr. 1, das sonstige Fehlverhalten aus 5 Nr. 2 als auch die Ausnahme zu Gunsten sonstiger legitimer Interessen auf, deren Schutzumfang und Entwicklungspotential die Untersuchung herausarbeitet. »The Exceptions to Trade Secret Protection«: Sec. 5 of the German Trade Secrets Protection Act provides exceptions to the prohibitions in Sec. 4. The exceptions require further specification. The aim of the present study is to specify these exceptions.
