Description
Brasilien wurde mit seiner Unabhängigkeit im Jahr 1822 ein konstitutionelles Kaiserreich mit dem portugiesischen Thronfolger an der Spitze. Das Verfassungsprojekt der Verfassungsgebenden Versammlung scheiterte, stattdessen wurde ein Verfassungsoktroi erlassen. Die Autorin untersucht die Diskussionen der Verfassungsgebenden Versammlung und den öffentlichen Diskurs um die Verfassungsgebung. Ferner prüft sie den Einfluss europäischer Verfassungen auf das Verfassungsprojekt und das Verfassungsoktroi. »The Emperor and the Constitution. An Analysis of Brazilian Conceps of Sovereignty in the Brazilian Constitutional Debates 1821-1824 against the Background of Early European Constitutionalism«: After its independence in 1822, Brazil became a constitutional empire with the Portuguese heir to the throne as its head of state. The Constituent Assembly's constitutional project failed, and instead a constitutional octroi was enacted. The author examines the discussions of the Constituent Assembly and the public discourse surrounding the constitution-making process. Literatur-und Stichwortverzeichnis Franziska Meyer studied law at the University of Passau. She then worked as a research assistant in the ERC grant project »Reconsidering Constitutional Formation« under the supervision of Prof. Dr. Ulrike Müßig. She completed her legal clerkship at the Hanseatic Higher Regional Court of Hamburg in 2021 with the Second State Examination. In 2022, she was awarded a doctorate in law. She has been a lawyer and criminal defence attorney since 2022.
