Den Staat treffen Schutzpflichten insbesondere für die Rechtsgüter Leben und körperliche Unversehrtheit. Für sie entsteht durch die Geltung des Geistlichenprivilegs nach 139 Abs. 2 StGB ein Schutzdefizit. Ob sich dieses durch das besondere Gewicht der Religionsfreiheit rechtfertigen lässt, wird in der vorliegenden Arbeit beleuchtet. Dazu wird ausgehend von der Einschränkbarkeit des Art. 4 GG die Verfassungsmäßigkeit des 139 Abs. 2 StGB hinsichtlich der Erfüllung der Schutzpflicht untersucht. »The Clergy's Privilege - Unconstitutional Special Religious Right? 139 sec. 2 StGB and the Constitutional Protection of Life and Physical Integrity«: The state has a duty to protect, amongst others, the legal interests of life and physical integrity.
