Individual guarantees are an essential part of the European judicial area in criminal matters. Actually, there could be no such thing as a European judicial area which did not put individual guarantees at the basis of its foundation. The high peak reached by international terrorism with 9/11 has determined a dramatic drive for the European action in devising instruments and measures for a stricter cooperation in criminal matters, pushing towards the realisation of the connected objectives of mutual recognition and harmonisation of domestic laws. Terrorism, at the same time, is probably the phenomenon giving rise to the most serious problems in terms of substantial and procedural rights. The need for a deeper harmonisation of rules at the EU level, as far as procedural guarantees for suspects and defendants are concerned, is largely felt. That is why the Commission has made some proposals, which have not yet been adopted by the Council and Parliament. The debate on terrorism and the respect of procedural rights, after a period of fatigue, is again extremely topical in today’s European Union. The present volume offers a rich collection of essays and official documents on the theme, with the aim of contributing to a better understanding of the main challenges that terrorism poses to legal systems based on the rule of law. En effet, un espace judiciaire européen qui ne se base pas sur les garanties individuelles n’est pas concevable. Le pic rejoint par le terrorisme avec le 11 septembre a donné une forte impulsion à l’action européenne ayant pour but de mettre en place des instruments et des mesures pour une coopération plus étroite en matière pénale, dans la poursuite des objectifs de la reconnaissance mutuelle et de l’harmonisation des droits internes.
